If you have concerns about the medical care you or a family member received, your medical records are usually the starting point. You have a right to access them, and the process is more straightforward than many people expect. This page explains how to request them and what to do next.
Your right of access
Under the General Data Protection Regulation (GDPR) and the Data Protection Act 2018, you have the right to access the personal data a healthcare provider holds about you — including your medical records. This is made through a Subject Access Request (SAR).
How to make the request
- Identify the right holder of the records: the hospital, GP practice, consultant, dentist, or the HSE department involved.
- Put the request in writing (many providers have a request form). State clearly that you are making a Subject Access Request for your medical records.
- Include enough detail to identify yourself and the records, and provide ID if asked.
- For a child or a person who lacks capacity, additional authority or documentation may be required.
Timeframes and cost
A provider must generally respond within one month. In most cases there is no fee for a first request, although a reasonable charge may apply to repeat or excessive requests. If the response is delayed or incomplete, you can follow up and, if necessary, raise it with the Data Protection Commission.
