What is the difference between a Grant of Probate and Letters of Administration?
A Grant of Probate is issued where the deceased left a valid will naming an executor. Letters of Administration are issued where there is no valid will — the estate is distributed according to the intestacy rules and the administrator is typically the next of kin.
What taxes apply on death in Ireland?
The estate may be liable for Capital Acquisitions Tax (CAT) if the value received by any beneficiary exceeds their tax-free threshold (€335,000 for a child, €32,500 for other relatives, €16,250 for others). Income tax returns for the deceased must also be filed.
Who can act as executor of an estate?
Any adult named in the will can act as executor. They must have legal capacity and be willing to take on the responsibility. A solicitor can be appointed as executor, or can advise an executor throughout the process.
