An agency agreement in Ireland sets out the terms on which a commercial agent sells or negotiates on behalf of your business. Appointing a commercial agent creates statutory rights for the agent under the EC (Commercial Agents) Regulations, including commission and compensation on termination. In this service, a solicitor would draft an agency agreement covering territory, exclusivity, commission, duties, term and termination that reflects those rules.

What’s included

  • A professionally drafted agency agreement
  • Covering territory, exclusivity, commission, duties, term and termination
  • Drafted to reflect the EC (Commercial Agents) Regulations
  • Self-complete template with guidance notes — you fill it in yourself
  • Documents tailored to Irish law and your circumstances, delivered by email
  • A written summary of the key points and anything you need to do afterwards

Who this is for

  • Businesses appointing a sales agent in Ireland
  • Overseas companies appointing an Irish agent
  • Businesses replacing an informal agent arrangement with a written agreement
  • Principals who want to understand their obligations to an agent

How it works

  1. Find a solicitor through the Law Society of Ireland’s Find a Solicitor directory and send them the basic details and any existing documents or correspondence.
  2. Complete a short questionnaire about your circumstances.
  3. A solicitor would then draft the agency agreement to reflect your arrangement and the Commercial Agents Regulations.
  4. The completed work is delivered to you by email, with plain-English notes on what to do next.

Frequently asked questions

How much does an agency agreement cost in Ireland?

This page is a free guide — nothing on it is for sale. Solicitors set their own fees for this work and must give you a written costs estimate (a section 150 letter) before starting. Get quotes through the Law Society of Ireland’s Find a Solicitor directory.

What rights does a commercial agent have in Ireland?

Commercial agents have statutory rights under the EC (Commercial Agents) Regulations, including rights relating to commission and compensation when the agency ends. The agreement needs to reflect these rules.

What is the difference between an agent and a distributor?

An agent negotiates or concludes sales on behalf of the solicitor, while a distributor buys goods and resells them on its own account. The legal rules differ, so choosing the right structure matters.
