Frequently Asked Questions
What is an upward-only rent review in Ireland?
An upward-only rent review means the rent can only increase (or stay the same) at review — it can never decrease, even if market rents have fallen. This type of clause is prohibited in new commercial leases signed after February 2010 but remains common in older leases.
What is a full repairing and insuring (FRI) lease?
An FRI lease makes the tenant responsible for all repairs (including structural repairs) and for insuring the building. This can create significant financial exposure. A schedule of condition at the start of the lease limits your liability to the property’s condition when you took it on.
Can I assign my commercial lease to someone else?
Usually only with the landlord’s consent. Most commercial leases restrict assignment and subletting. Check the alienation provisions carefully — some leases effectively trap you in the property if your business changes.
