A personal guarantee of a loan in Ireland is a promise by a third party to repay a borrower’s debt if the borrower does not. Where a lender wants a third party to stand behind a borrower, a written guarantee is required. In this service, a solicitor would draft the guarantee to match the loan terms, including the guaranteed amount, demand provisions and whether the guarantee is joint and several. Independent legal advice for a guarantor can be arranged separately.

What’s included

  • A professionally drafted personal guarantee of a loan
  • Matched to the loan terms, including the guaranteed amount, demand provisions and whether it is joint and several
  • Independent legal advice for a guarantor can be arranged separately
  • Self-complete template with guidance notes — you fill it in yourself
  • Documents tailored to Irish law and your circumstances, delivered by email
  • A written summary of the key points and anything you need to do afterwards

Who this is for

  • Lenders making a private loan who want a guarantee from a third party
  • Businesses lending to another company with a director’s guarantee
  • Family members lending money and asking for a guarantee
  • Parties who want the guarantee to match the loan agreement exactly

How it works

  1. Find a solicitor through the Law Society of Ireland’s Find a Solicitor directory and send them the basic details and any existing documents or correspondence.
  2. Complete a short questionnaire about your circumstances.
  3. A solicitor would then draft the guarantee to match the loan terms.
  4. The completed work is delivered to you by email, with plain-English notes on what to do next.

Frequently asked questions

How much does a personal guarantee cost in Ireland?

This page is a free guide — nothing on it is for sale. Solicitors set their own fees for this work and must give you a written costs estimate (a section 150 letter) before starting. Get quotes through the Law Society of Ireland’s Find a Solicitor directory.

Does a guarantor need independent legal advice?

It is strongly recommended. A guarantee can expose the guarantor to significant personal liability, and independent advice helps make sure they understand it. This can be arranged separately.

What does joint and several mean in a guarantee?

Where there are several guarantors, joint and several liability means the lender can pursue any one of them for the full amount, not just their share.
