Why Template T&Cs Are a Commercial Liability
- They reference the wrong law. Irish consumer law is stricter than the UK in several areas (digital content, distance selling, chargebacks). UK templates frequently reference sections of the Consumer Rights Act 2015 or the Misrepresentation Act 1967 that do not apply here.
- They will not be enforceable in a dispute. A “choice of law” or “jurisdiction” clause that picks the wrong forum is often struck out by an Irish court.
- They expose you to avoidable liability. Standard consumer-facing templates rarely include proper limitation-of-liability clauses, IP protection, or payment terms calibrated to Irish trading patterns.

Can I use UK or US terms and conditions?
No. Irish and EU consumer protection law differs from both. A UK-drafted clause referencing the UK Consumer Rights Act 2015 carries no weight in an Irish court.
