Where a person can no longer make certain decisions even with support, the Circuit Court can appoint a decision-making representative under the Assisted Decision-Making (Capacity) Act 2015. This fixed-fee service supports the application from start to finish.
We advise on whether a representation order is appropriate, prepare the court application and supporting documents, address the capacity evidence required, and guide you through the role and reporting duties of a decision-making representative to the Decision Support Service.
It is for family members and carers who need formal legal authority to make personal welfare or property and financial decisions for a relative who lacks capacity for those matters.
