Being dismissed from your job is one of the most stressful things that can happen. In Ireland, you have strong legal protections — but you need to act quickly. Here’s what you need to know.

What is Unfair Dismissal?

Under the Unfair Dismissals Acts 1977–2015, an employee dismissed without a fair reason or fair procedure may bring a claim to the Workplace Relations Commission (WRC). Awards can reach up to 104 weeks’ remuneration.

Do You Qualify?

You generally need 12 months’ continuous service with the same employer. Exceptions exist for dismissals related to pregnancy, trade union membership, or certain statutory rights — these can be claimed from day one.

What Makes a Dismissal Unfair?

  • No valid reason given
  • No disciplinary process followed
  • Disproportionate response to the alleged issue
  • Selection for redundancy was unfair
  • Dismissal related to a protected characteristic

Time Limit: Act Within 6 Months

You have 6 months from the date of dismissal to lodge a WRC claim (extendable to 12 months in exceptional circumstances). Don’t delay.
