Being made redundant is stressful. Understanding your legal rights in Ireland can make a significant difference to what you receive and what happens next. This guide explains statutory redundancy entitlements, your rights during the process, and when you should get legal advice.
What Is Statutory Redundancy in Ireland?
Statutory redundancy is the minimum payment you are legally entitled to under the Redundancy Payments Acts 1967–2022. In Ireland, statutory redundancy is calculated as two weeks’ gross pay per year of service, plus one bonus week, subject to a weekly earnings cap of €600.
Who Qualifies for Statutory Redundancy?
- Employed under a contract of employment (full-time or part-time)
- At least 2 years’ continuous service with the same employer
- Aged 16 or over
- Your role has been made redundant (genuine redundancy situation)
What Notice Are You Entitled To?
You are entitled to statutory notice based on your length of service: 1 week after 13 weeks, 2 weeks after 2 years, and up to 8 weeks after 15+ years. Your contract may provide for longer notice — always check both your statutory and contractual entitlement.
What If Your Employer Offers Enhanced Redundancy?
Many employers offer enhanced redundancy — more than the statutory minimum. Before signing any agreement, have a solicitor review the terms. In particular, check whether you are being asked to waive future claims (such as unfair dismissal or discrimination claims) in exchange for the payment.
When Is a Redundancy Unfair?
A redundancy is unfair if it was not a genuine redundancy situation, the selection for redundancy was discriminatory or unfair, or proper procedures were not followed. In these cases you may have grounds for an unfair dismissal claim at the WRC. You have 6 months from the date of termination to file a complaint.
